Man gets aggressive with his car against child, his mouth vs. police

A West Bend man has been charged  with felony hit and run causing injury after he allegedly struck a 10-year-old boy with his car in Fredonia and left the scene.

According to a criminal complaint filed in Ozaukee County Circuit Court, Frank Erwin Rose, 52, struck the boy as he was crossing the street in the crosswalk at Highland Drive and Fredonia Avenue with his two sisters on June 25.

The car struck the boy on the right side, knocked him down onto his left side and caused him to slide on the pavement.

According to witnesses, Rose got out of the car and yelled at the children, who yelled back and told Rose to leave. 

Rose got back into his car and drove off without leaving his information or checking on the severity of the boy’s injuries, according to the complaint.

The boy suffered “road rash” on his side. Emergency medical services arrived but the boy and his mother decline medical treatment, according to the complaint.

One witness said the boy was struck hard enough that his feet flew into the air.

Witnesses also provided a description of the car, a gold sedan, and the license plate number, which was registered to Rose.

Rose contacted an Ozaukee County Sheriff’s deputy who was investigating the incident, according to the complaint.

Rose admitted he struck the child with his car. When told “enforcement action” would be taken against him, Rose became “verbally aggressive,” yelled at the deputy using profanity and refused to meet with the deputy in person, according to the complaint.

A West Bend police officer also talked to Rose and said Rose was verbally aggressive with him as well. Rose also refused to provide an updated address to the police officer, according to the complaint.

If convicted, Rose could be fined up to $10,000 and sentenced up to nine months in prison.

Rose posted $350 bond and is due to appear in court in December, according to online court records.
