Drunk driver busted by Taco Bell employees sentenced to jail

He pleads no contest to fourth OWI charge

A man who was so noticeably drunk when he pulled up to a drive-through this summer that the Saukville restaurant’s employees called police was convicted of fourth-offense drunken driving in Ozaukee County Circuit Court last week.

Joshua K. Evje, 38, of Port Washington, pleaded no contest to the felony charge during a Dec. 8 hearing before Judge Steve Cain.

Cain withheld a prison sentence, placed Evje on probation for three years and ordered him to serve a year in jail as a condition of probation.

When Evje drove through the Taco Bell drive-through just before midnight on July 8, restaurant employees told police, he could barely keep his eyes open, according to a criminal complaint.

The employees recorded his license plate number and told police that he drove north on Foster Street toward Green Bay Avenue after leaving the restaurant.

Officers found Evje in his car parked at the nearby Kwik Trip eating the food he had just purchased.

The officer said Evje had bloodshot eyes, smelled of alcohol and was slow to respond to questions, although he denied drinking or taking drugs.

Evje performed poorly on field sobriety tests and, according to a preliminary breath test, had a blood alcohol level of .244, the complaint states.

While a blood alcohol concentration of .08 is the standard threshold for intoxication, Evje was prohibited from having a concentration of more than .02 because of his prior drunken driving convictions.

During last week’s hearing, Cain also ordered Evje to have an ignition interlock  device on any vehicle he drives for 36 months and revoked his driver’s license for 36 months.
