Walmart worker faces prison for ‘up-skirt’ pic

Prosecutor recommends 18 months for man who photographed customer

A 23-year-old man who was working at the Saukville Walmart store when he reached under a woman’s dress with his cell phone and took a photo in 2023 pleaded no contest to two felonies last week.

Justin G. Aman’s pleas were accepted by Ozaukee County Circuit Judge Steve Cain, who found him guilty of invasion of privacy and capturing an intimate image without consent.

Two counts of possession of child pornography and one misdemeanor count of disorderly conduct were dismissed as part of a plea agreement but read into the record, which means Cain can consider them when he sentences Aman on Aug. 8.

During a June 6 hearing, Ozaukee County District Attorney Adam Gerol recommended Aman be sentenced to 18 months in prison and two years of extended supervision on the invasion of privacy conviction and that Cain withhold a sentence on the second felony and place Aman on probation for three years. The probation would be consecutive to the extended supervision, which means Aman would be supervised by the Wisconsin Department of Corrections for five years after serving his prison time.

Gerol also recommended that Cain order Aman to register as a sex offender for 15 years.

The case dates to Friday, June 2, 2023, when at 7:55 p.m. police officers were called to the store and spoke with a woman who said she was shopping in the beauty aisle when she turned around to see Aman reaching under her dress with his cell phone in his hand, according to a criminal complaint.

When confronted by the officers, Aman said he was using his personal cell phone to scan products while stocking shelves but admitted to switching his phone from the Walmart app to his camera, putting the phone between the woman’s legs and trying to take a photo up her dress.

Aman said he didn’t know if he captured  an image, then gave authorities permission to look at his photos. Officers found that the most recent images on his phone were so-called “up-skirt” photos of a woman wearing a dress that matched the one worn by the woman who reported the incident.

Also found on the phone were images of other female customers and an employee that focused on their butts, the complaint states.

When asked if he had taken other up-skirt photos, Aman said he took one of a woman last year. Officers found that photo on his phone and noticed it was taken at the Walmart store

After obtaining a warrant, authorities searched Aman’s phone and found what they believed to be three lewd images of prepubescent girls, according to the complaint.

During last week’s court hearing, Gerol recommended that in addition to having no contact with the woman who reported the Walmart incident, Aman be ordered not to have contact with anyone younger than 18 or use the internet without the approval of his probation agent.
