A 55-year-old man questioned by an Ozaukee County sheriff’s deputy because he was taking photos of young girls who live at the same Fredonia apartment complex he does was bound over for trial last week on two felony counts of possessing child pornography after other images were found on his phone.

Timothy C. Albert also faces charges in Ozaukee County Circuit Court of second-offense possession of marijuana, possession of drug paraphernalia and disorderly conduct.

He pleaded not guilty to the charges during a June 16 hearing.

Authorities were called to the apartment complex at 5 p.m. Monday, May 30, by a woman who said she saw photos of her daughters on Albert’s phone after one of the girls told her he was taking pictures of them, according to the criminal complaint.

Albert allowed a deputy to inspect his phone, and on it the officer found photos of the girls playing, including close-ups of their backsides, the complaint states.

Albert was arrested and searched. The deputy found marijuana on him, as well as a pipe that he said is used to smoke pot.

The contents of Albert’s phone, which were downloaded and inspected with his consent, included 10,766 images, the majority of which were pornographic, the complaint states.

A detective concluded that two of the pornographic images depicted females younger than 18 — one believed to be between 11 and 13 and the other between 12 and 14 years old.

During a June 3 court hearing, Ozaukee County Circuit Judge Sandy Williams set bail for Albert at $25,000 and ordered him not to have contact with anyone younger than 18 or access the internet. He also must maintain absolute sobriety and cannot posses or consume controlled substances while awaiting trial.

As of earlier this week, he remained in the county jail.

Possession of child pornography is punishable by at least three years in prison and no more than 15 years in prison and 10 years of extended supervision.
