Port council adopts ordinance to keep registered offenders from being in places where children congregate

    The Port Washington Common Council on Tuesday approved an ordinance intended to stop registered sex offenders from loitering in areas where children congregate.

    The ordinance prohibits sex offenders from being in areas where children congregate, such as parks, playgrounds, day-care centers and schools, while youngsters are expected to be present and from loitering within 200 feet of these areas.

    In a city with an abundance of parks, that limits where sex offenders can spend their time, City Attorney Eric Eberhardt said.

    “The ordinance is broad,” he said, noting it includes businesses where youngsters congregate, such as the Ozaukee Sports Center, as well as such places as schools and child-care centers.

    While many communities have chosen to regulate where sex offenders live, Port Washington chose to regulate where they spend their time, something suggested by a Department of Corrections officer.

    “A loitering ordinance is really what makes sense,” Vicki Seibel-Garvey, a corrections field supervisor for the Department of Corrections, told aldermen when the ordinance was introduced earlier last month.

    Residence regulations “tell people here is where you can and can’t sleep,” she said. “A loitering ordinance regulates where a person spends their time.”
