Man convicted in child porn case faces new charge

Belgium resident allegedly violated terms of supervision by buying phone to ‘date people’

A Belgium man who was convicted almost 12 years ago of taking nude pictures on his phone of a young girl is back in court after allegedly buying a second phone “to date” people, violating the terms of his supervision.

According to a criminal complaint filed last month in Ozaukee County Circuit Court, Don M. Bates III bought the second phone online under the name Robertmould so he could “reach out to find friends and to date, meet people.”

According to the complaint, he admitted to investigators that he did not tell his probation agent about the new phone “because there was a rule that he could not meet people or date as he was on supervision” and on the sex offender registry.

A check of “Robertmould’s” Pinterest page “appeared to be more in the nature of erotica,” the complaint states.

Bates was convicted of possessing child pornography in 2007 after his wife found pictures on his phone of a 5-year-old girl. Bates was living in Mequon at the time.

Bates pleaded no contest to that charge and was sentenced to seven years in prison and 10 years of extended supervision.

On Monday, Bates waived his preliminary hearing on the new charge of violating his sex offender registry and was bound over for trial.

He is scheduled to be arraigned on Aug. 6.

If Bates is convicted of the felony, he could be imprisoned up to three years, followed by up to three years of extended supervision. 

Bates is in custody. Bail has been set at $5,000 cash.
